Over the past 35 years, we have developed relationships with insurance companies, property managers, CPAs, and vendors that will benefit our insured Associations. Before submitting applications, we personally inspect each Association, review the CC&R’s, existing policies, Reserve Study, County Records and other pertinent documents. This is so we can identify missing coverages or over-insurance and to be sure the insurance meets the requirements of the Association’s CC&Rs and the Davis Sterling Act.

We provide Master as well as stand-alone policies for General Liability, Property, Directors & Officers Liability, Fidelity Bonds, Umbrella Liability, Earthquake, Flood, Landslide and Workers’ Compensation. Workers’ Compensation can be written for Associations with and without employees so that the Directors/Officers, Committee Members and Volunteers can be covered while attending to Association business.

COMPREHENSIVE GENERAL LIABILITY

Limits are based on:

  • Governing Documents (CC&Rs) and Current Civil Code (5805)
  • Associations with fewer than 100 units must carry a minimum limit of $2,000,000
  • Associations with 100 units or more must carry a minimum limit of $3,000,000
  • Other factors include the number of units and exposures that the Association has such as play equipment, pools, etc.
  • Occurrence – A single incident that results in injury or damage neither expected nor intended by the Association
  • General Aggregate – The most the insurance company will pay for any and all liability occurrences or losses during any one policy year

LIABILITY COVERAGES

The policy insures third party claims arising from alleged bodily injury or property damage. It includes the defense of the Association against claims alleging damages even if the Association is not negligent.

Personal Injury – Insures against:

  • False arrest
  • Imprisonment
  • Malicious prosecution
  • Liable
  • Slander and defamation of character
  • Invasion of privacy
  • Wrongful eviction
  • Wrongful entry

Medical Payments – Covers medical expenses of members of the public injured on the common property.

Hired Auto — Extends liability to a third party if you cause an accident while you are driving a rented, leased or borrowed vehicle for business.

Non-Owned Auto Liability — The same scenario applies if a board member runs an errand in his or her own car.

DIRECTORS AND OFFICERS LIABILITY

Protects against claims arising from mismanagement or wrongful acts.

  • Wrongful Act – any Breach of Duty, Neglect, Error, Misstatement, Misleading Statement or Omission.
  • Covers expenses incurred in defending lawsuits arising from the alleged wrongful acts of the Officers or Directors.
  • Common Exclusions: Fraudulent or Illegal Acts, Failure to Maintain Adequate Insurance (Including Earthquake Insurance, Pollution, Construction Defects and Bodily Injury.)

EMPLOYEE DISHONESTY (CRIME/FIDELITY BOND)

  • Covers the Association for loss of money or securities due to the intentional acts of an employee.
  • Directors, officers and management company employees may be deemed employees of the association.
  • Examples of Dishonest Acts include theft, larceny and embezzlement.
  • Limits are based on:
    • Governing Documents (CC&Rs)
    • Requirement is usually a limit equal to three or six months of the association fees plus Reserves

WORKERS’ COMPENSATION

  • Covers claims for work-related injuries or diseases suffered by employees that are hired by the association.
  • Directors/Officers, Committee Members and Volunteers can be included.
